2009 Activities Photo Contest Rules

Eligibility

Only United States residents who are 14 years of age or older at the time of entry may participate in the Activities Photo Contest (the "Contest"). The Contest is void where prohibited by law, or where the registration requirements of any state of local jurisdiction have not been complied with. Employees of Education.com (the “Sponsor”) and their immediate families can participate in the Contest but are not eligible to win any prize.

Contest Dates

The contest begins at 12:00:00 a.m. Eastern Time on September 23, 2009 (the “Begin Date”). The contest will end on December 31 at 11:59:59 p.m. Eastern Time (the “End Date”). Photos uploaded after the End Date will not be counted as contest entries.

How to Enter

No purchase or payment is necessary to enter the Contest. Eligible parties (“Entrants”) must complete each of the following steps in order to enter the Contest:

  1. Submit a contest entry form

Registration for the Contest can be completed on and after the Begin Date by clicking the “Sign Up” button on the Contest Overview page. Contest registration includes irrevocable acceptance of these rules. Those who are not yet subscribed members of Education.com will be required to become members of Education.com prior to submitting the Contest entry form. Education.com membership is free.

  1. Take and upload to Education.com original photographs of any of the start-to-finish elements in completing Education.com Activities prior to the End Date.

To be eligible for the contest, photographs must meet Education.com’s Photo Upload Terms, and be uploaded to the Education.com web page for each Activity that the photograph(s) portray, either through the “Share Your Photos To Win” module at the top of each Activity page or attached to a comment in the Comments section at the bottom of each Activity page. Any other form of online entry and mail-in entries will not be accepted.

Photographs must include any of the start-to-finish elements in completing each Education.com Activity, including shots of the activity supplies, important steps and actions, and the finished product. Each eligible photograph is one (1) entry in the Contest.

Sponsor is not responsible for entries that are late, misdirected, lost, garbled, or unintelligible, whether due to computer or network malfunction, congestion (including at Sponsor), or any other reason, and any such entries are not eligible.

Sponsor reserves the right to reject and disqualify from the Contest any entry that does not comply with the instructions provided in the image uploader on the Activity web page, that does not meet the Education.com Photo Upload Terms, and/or that does not meet the Contest Rules.

An Entrant may withdraw from the Contest at any time by using the “Sign Me Out” link on the Contest Overview page. Once withdrawn, all photos submitted by the Entrant cease to be eligible for prizes, whether submitted before or after the withdrawal. Any photos previously submitted and selected as a winner, however, will remain as part of the Contest and as a showcased winning photograph.

Judging Criteria

Eligible entries will be judged by members of the Sponsor’s staff. Each eligible photograph will be treated as a single work, and will be judged as a whole against other entries submitted during each judging period. Entries will be judged on the following criteria: how well the photograph conveys any of the start-to-finish elements of completing its corresponding Education.com Activity; and overall quality of the photograph. The decision of the judges will be final.

Judging Periods & Winner Notification

  • Using the judging criteria above, Education.com will select and showcase a total of 100 winning photos from eligible photo submissions during the 100-day Contest period.

  • Every Monday during the Contest and on January 4, 2010, new winning photos will be selected from the previous week’s pool of eligible submissions. Each week’s winner selection pool consists of eligible photographs received from Sunday at 12:00:00 a.m. Eastern Time to Saturday, 11:59:59 p.m. Eastern Time, with the exception of the first week (in which the selection pool consists of eligible photos received from Wednesday, September 23, 2009, 12:00:00 a.m. to Saturday, September 26, 2009, 11:59:59 p.m. Eastern), as well as the last week (in which the selection pool consists of eligible photos received from Sunday, December 27, 2009, 12:00:00 a.m. to Tuesday, December 31, 2009, 11:59:59 p.m. Eastern Time). Any photos that are removed from Education.com by the Entrant or by Education.com for any reason during each week’s judging period will not be eligible for selection as a winning photo for that week.

  • Winning photos will be showcased on the Winners’ Page on Education.com, and may not thereafter be deleted by the Entrant who submitted the photo.

  • Submitting a winning photo does not thereafter eliminate the Entrant from the Contest. Entrants may continue to submit eligible and winning photos each week throughout the duration of the Contest.

  • The grand prize package winner will be announced on Friday, January 8, 2010. The grand prize package will be awarded to the Entrant who submitted the best of the 100 winning photos, as determined by the Sponsor based on the judging criteria referenced above.

  • In addition to awarding prizes for 100 winning photos based on the judging criteria, Education.com will also award 50 participation prizes. After the Contest, the participation prize winners will be selected via a random drawing from all eligible uploaded photo submissions during the Contest.

  • The Entrant(s) who submitted the selected winning photos and all participation prize winners will be notified by email, and will be required to provide to Education.com a mailing address before January 15, 2010 to receive their prize. Failure to provide the prize mailing address by January 15, 2010 shall mean that the Entrant forfeits the prize. Prizes can only be shipped to U.S. addresses, and cannot be shipped to Post Office boxes.

Prizes

The winning photo and participation prizes include: a Kenny Loggins family CD, “All Join In” (with an approximate retail value of $20); a Putumayo Kids CD, “European Playground” (with a retail value of $15); Bill Harley's song “Wash Your Hands” on CD (which is not for sale/does not have an approximate retail value); and/or a children’s guitar from BerkeleyWind.com (with a retail value of $29). Each winning photo and participation prize that is awarded will be selected by Education.com. The grand prize package includes a $500 gift certificate to Shutterfly and a $250 cash prize from Education.com.

All winners are solely responsible for any and all taxes and/or fees as well as all additional costs that may be incurred. If the specified prize becomes unavailable for any reason, Education.com in its sole and absolute discretion may substitute a prize of like or equal value.

Neither Education.com nor its officers, partners, directors, employees, agents, successors, or assigns shall be liable for any warranty, costs, damage, injury, or any other claims incurred as a result of the usage of a prize by any winner. Each Entrant’s odds of winning a participation prize depends upon the number of entries received and cannot be determined in advance.

A list of winner(s) may be obtained by visiting the Winners’ Page on Education.com during the Contest through January 15, 2009, or by sending a self-addressed, stamped (first-class postage) envelope to Education.com after January 15, 2010 and no later than February 28, 2010.

Additional Conditions

The Contest is governed by the laws of the United States and is subject to applicable federal, state, and local laws and regulations. All federal, state, and local taxes, fees and surcharges on prize packages are the sole responsibility of the winners.

Education.com reserves the right in its sole and absolute discretion to alter any of the Contest rules at any time or to terminate the Contest at any time without prior notice, and to select winners from among all eligible entries received prior to the cancellation date.
