Academic Intervention Services for English

We live in NYS. My son is in 9th grade and has been AIS for English since elementary school.  He carries about a 80 average in English but performs badly on the stupid state tests so they keep putting him in these classes. And this year, he did even worse because the state tests changed.  As far as I'm concerned, these classes don't work and the state tests are not an indicator of his abilities. If these classes actually worked, he wouldnt still be in them.  Can I request the school take him out?
