Is calling a special needs student a retard bullying?
According to the school it is not, even their attorney told me it was name calling only, on tape during an ARD. My son is a Special needs student and has been called a retard all of his school years. A teacher who hadn't read his IEP stood up in front of a class and said What are you a retard, when he could not multiply. How can I stop this from occurring at the school!

It seems like the school is trying to protect themselves and justifying the bullying by calling it name calling. This name calling was used as a put down and derogatory remark. It was not calling him a name such as wimp or smelly. This was a direct insult to his intellectual level.
If you feel like you have been wronged and want to find support for your son in this school you could always go to the school board if the principal is not willing to listen. You can let them know you will start bringing light to the intentionally ignored bullying issue at the school. You can contact Disability Rights Organization in either your state or a national organization. They might be able to help you bring attention to the issue inside the school.
