can a school fill a child's place before they have a new place?

we were due to move house in the holidays, & applied for school places in that area. I was set a letter offering a place for my daughter to start year 4 in September. We had two weeks to accept the place or it would be withdrawn. Unfortunately  we were unable to move therefore not accepting the place. I sent an e-mail to the head teacher prior to the summer holidays, stating that my daughter would not be returning to school. I tried to take my daughter back to her old school today, & was told her place had been given to another child. I am sure that a school cannot give up a child's place until they have started at their new school! Can anyone advise me as my daughter has not got a school to go to!
