How do I know if my child really needs an IEP plan?

My child has faired well in a past sate math exam.  There is continuous disruptions in the class, harassment and bullying. During tests, quizzes, state exams this type of behavior is still present. The teachers and staff has condoned this through their silence. They have watched and allowed this to occur. I believe my child could fair well if not for defending, frequent disruptions, intimidation and fear on school. The schools receive funding for services they provide for students with disabilities. How do I know I my child even really needs this plan? Outside testing will not truly reflect because my child has not been give the opportunity to truly learn in a non hostile environment.
