Good question.  I'm not sure what your school districts policy is, but you may want to push the issue a little bit.  If you are not getting any where with your son's school, try contacting the district offices.  Check out the district's website and see if there is a department called Offices of Prevention, or Health and Well-being.  If you still are hitting a road block, try contacting your school board representative.  As a last resort, you may want to contact a lawyer to see what your rights are.

If your son is being bullied, you need to stay involved.  I did write a response to another parent whose daughter was being bullied.  I gave her some steps to follow. has some great information on the topic.  Be sure to check it out.

Remind your school, that they need to provide a safe environment for your child to learn.  Tell them that you want to work with them to make this happen, not just for your son, but all the children.

Oh, also ask your son if this bullying is spilling over once he is at school or if it is coming home with him - as in cyberbullying.

Good luck!  And stay on top of this.
