How can I fight a 3rd grade retention in FL?

My 9 year old got retain in the 3rd grade. I believe the school is at fault. I asked for her to be tested (IEP) but the process took over a year. Well the teacher forgot to put in the paper work and it did not go in until after Jan. when I went in to complain.
I have so many complains and concerns but want to make this question short.
How or what can I do to fight this retention? Or at least file a formal complaint against the teacher?
