I think you have to check your local laws. In Pennsylvania, Kindergarten is not mandatory. It is really helpful for kids to attend at least a 1/2 day program to get them socially ready for the classroom experience of first grade.
While my little one had attended a day care, he was not prepared for the structure of classroom environment. 1/2 day Kindergarten makes the transition to full day at a desk in first grade MUCH easier for both the child and the teacher.
