Services Provision Requirements for Individuals with Disabilities

This table illustrates the services mandated under the Section 504 of the Rehabilitation Act of 1973, The Education for All Handicapped Children Act and its amendments, and The Americans with Disabilities Act.

Right to recreation All public parks and recreational facilities constructed with federal funds after 1976 must be accessible. Individuals served in residential facilities must be provided recreational programs.
Right to education Free and appropriate public education must be provided to all individuals ages 3-21. Education must include necessary related services, an individualized education program, and family consent for evaluation and placement.
Right to the development of an individualized education program Individuals with disabilities served in public school programs must receive the written document describing their current educational levels, annual goals and short term objectives, specific services to be provided and specific service providers, anticipated date for initiating and completing services, criterion for the success of the program, and extent to which services are provided in the least restrictive environment. Family members must be invited to participate in the development of the written program. To the extent possible, the individual with disabilities may also be asked to participate.
Right to vocational rehabilitation All individuals having a reasonable chance to obtain and hold employment are eligible for specific vocational rehabilitation services. These include: vocational evaluation; career guidance, employment counseling, employment placement; medical, surgical, and psychiatric care related to employment; provision of prosthetic devices; vocational training; basic living expenses and transportation related to medical treatment or vocational training; work related equipment, uniforms, and licenses; and rehabilitation engineering to accommodate work demands. These benefits must be summarized in an annual individualized written rehabilitation plan.
Right to summer school Individuals ages 3-21 who are likely to regress substantially must be provided an extended school program at public expense.
Right to assessment in native language Hispanic, Asian, and other individuals for whom English is a second language must be assessed in the native language.
Right to social support Individuals with disabilities are eligible to receive Supplemental Security Income, Medicare, and Medicaid.
Right to an educational program while in residential care All institutionalized people have the right to treatment and habilitation required to develop or maintain skills that will lead to discharge from the facility.
